Justice Department Preserves The 2024 Election For Further Inspection

WASHINGTON—The Justice Department has instructed 29 states and the District of Columbia to preserve records from the 2024 election, ensuring that an election completed 22 months ago remains ready for the administration’s continuing voter-list litigation.

The letters direct officials to retain hard-copy documents and electronically stored information connected to federal lawsuits seeking statewide registration data. Those files can contain addresses, birth dates, driver’s-license information and portions of Social Security numbers. The department has argued that federal civil-rights law authorizes its requests.

Harmeet Dhillon, who leads the department’s Civil Rights Division, described the letters as standard litigation holds rather than threats. One letter told Utah Lt. Gov. Deidre Henderson that she was under investigation and warned that failure to preserve relevant material could bring civil or criminal sanctions. The department did not publicly explain the investigation beyond the pending dispute.

Election officials said they already retain federal-election materials under existing law. Several states have resisted surrendering complete voter files, citing privacy rules and the scope of federal authority, and judges have rejected multiple Justice Department efforts to compel production. Preservation is therefore the portion of the dispute on which everyone was already working.

The letters do not establish fraud in the 2024 election or announce criminal charges. They preserve the records while the government continues litigating for access to them. The election is over, the cases are not and the archive has been notified.
